PRODUCT LISTING POLICY

1. INTRODUCTION AND PURPOSE

1.1. This Product Listing Policy (the "Policy") outlines the mandatory rules, guidelines, and requirements that all individuals or entities registered to sell on the Gajab.com Platform ("Sellers", "You", "Your") must adhere to when creating, managing, and displaying product listings ("Listings") on the Gajab.com website (www.gajab.com) and associated mobile applications (collectively, the "Platform"), operated by Aeliya Technologies Private Limited ("Company", "We", "Us", "Our"). Gajab.com operates as an 'Intermediary' as defined under India's Information Technology Act, 2000 ('IT Act'). This Policy outlines Seller obligations necessary for Gajab.com to maintain compliance with applicable laws, including the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ('IT Rules') and the Consumer Protection (E-Commerce) Rules, 2020 ('E-commerce Rules')

1.2. The purpose of this Policy is to ensure all Listings are accurate, clear, complete, professional, legally compliant, do not infringe third-party rights, and contribute to a trustworthy and positive experience for buyers using the Platform ("Buyers") as well as to ensure Sellers meet their legal obligations towards Buyers and regulatory authorities

1.3. This Policy applies to all Sellers and all Listings submitted to or displayed on the Platform. Sellers are independent third parties solely responsible for the content of their Listings and the products offered therein. Gajab.com does not initiate the transmission, select the receiver of the transmission, or select/modify the information contained in the Listing.

1.4. This Policy supplements and forms part of the Seller Agreement. Adherence to this Policy is mandatory for all Sellers. Violations may lead to consequences outlined in Section 9 of this Policy and the aforementioned agreements.

2. GENERAL LISTING REQUIREMENTS

All Listings created by Sellers must adhere to the following general principles:

2.1. Accuracy and Truthfulness: Listings must accurately, truthfully, and completely represent the item being offered for sale. This includes its specifications, features, brand, origin, authenticity, and particularly its condition (see Section 6). Misleading, false, or inaccurate information in any part of the listing is strictly prohibited. The Seller bears sole responsibility for verifying and ensuring the continued accuracy and truthfulness of all information provided in their Listings.

2.2. Clarity and Completeness: Listings must be clear, easy to understand, and provide sufficient relevant information to allow a Buyer to make an informed purchase decision. This includes providing accurately all necessary disclosures required by applicable law, such as those under the Legal Metrology (Packaged Commodities) Rules, 2011 (as amended) the Consumer Protection (E-Commerce) Rules, 2020 and regulations specific to product categories (such as, FSSAI, Drugs & Cosmetics). Failure to provide any legally required declaration is a violation of this Policy. Avoid ambiguous, vague, or overly technical language where simpler terms suffice. 

2.3. Appropriate Language and Professionalism: Listings must be primarily in English, unless mentioned otherwise. The use of offensive, abusive, vulgar, discriminatory, hateful, illegal, or otherwise inappropriate language is strictly prohibited. Maintain a professional tone appropriate for commerce. 

2.4. Relevance and Categorisation: Items must be listed in the single most relevant and specific product category available on the Platform. Do not list items in inappropriate categories to gain visibility. Creating duplicate listings for the exact same item and offer is prohibited (see Section 8). 

2.5. Policy Compliance: All listings must fully comply with this Product Listing Policy, the Prohibited and Restricted Items Policy, the Intellectual Property Policy, the Seller Agreement, and all applicable Indian laws and regulations. 

2.6. Licences and Permits: Sellers must not list any product for which they do not hold all legally required licences, certifications, registrations, or permits necessary for selling that specific product in India (including but not limited to FSSAI licence for food products, BIS certification for certain electronics/goods , ISI mark where applicable for products covered under Compulsory Registration Scheme or Certification Schemes). Listing such items without valid, current licensing or certification is strictly prohibited and a violation of the Seller Agreement. You must display the licence number or mandatory certification mark prominently. Gajab.com reserves the right to request proof of such licences, certifications, or registrations at any time and may suspend or remove Listings or Seller accounts for failure to provide valid proof upon request.

2.7. All products listed must comply with all applicable Indian safety standards and regulations (including those set by BIS). Sellers are solely responsible for ensuring their products are safe for consumer use, are not counterfeit, defective, or subject to any governmental recall notices in India or internationally.

2.8. Listing products is contingent upon the Seller having successfully completed all identity and business verification processes (KYC) mandated by Gajab.com and applicable Indian laws (including IT Rules and E-commerce Rules), as detailed in the Seller Agreement.

2.9. Sellers must not engage in any 'unfair trade practice' as defined under the Consumer Protection Act, 2019. This includes, but is not limited to, making false or misleading representations about products, services, standards, quality, quantity, price, or sponsorship which may also constitute an offence under Section 318 of the Bharatiya Nyaya Sanhita, 2023 (Cheating).

3. LISTING TITLE REQUIREMENTS

The title of Your Listing must adhere to the following requirements:

3.1. Be clear, concise, accurate, and directly relevant to the specific item being sold. 

3.2. Accurately reflect the product's brand, key features, and type. 

3.3. NOT include promotional words or marketing phrases (such as "Free Shipping", "Lowest Price", "Sale", "Discount", "Best Offer", "Limited Stock", "Top Rated"). 

3.4. NOT include website URLs, external links, email addresses, phone numbers, social media handles, or any other form of contact information. 

3.5. NOT use excessive or unnecessary capitalisation (avoid writing titles entirely in ALL CAPS). Use standard title case or sentence case. 

3.6. NOT contain excessive or irrelevant keywords solely for the purpose of manipulating search results ("keyword stuffing").

3.7. NOT use misleading terms (such as making unsubstantiated claims like "100% Authentic" unless verifiable). 

3.8. NOT contain excessive or distracting special characters, symbols, or borders. Use standard punctuation only where appropriate.

4. PRODUCT DESCRIPTION REQUIREMENTS

The main description section of Your Listing must adhere to the following requirements:

4.1. Provide a detailed, accurate, and complete description of the item, covering its features, specifications, materials, dimensions, weight, colour(s), package contents (what the buyer will receive), compatibility (if relevant), country of origin, and any applicable warranty information (or lack thereof). 

4.2. Accurately and honestly describe the item's condition in detail, especially if not brand new (see Section 6). 

4.3. Be well-organised, clearly written in permissible language(s), grammatically correct, and easy for Buyers to read. Use of paragraphs and bullet points is encouraged for clarity.

4.4. Include all mandatory disclosures required by applicable Indian laws for the specific product category, including (where applicable) those under the Legal Metrology (Packaged Commodities) Rules, 2011 (such as Name and Address of the Manufacturer/Packer/Importer, Common or Generic Name of the Commodity, Net Quantity, Month and Year of Manufacture/Packing/Import, Maximum Retail Price (MRP), Consumer Care details). 

4.5. NOT contain false, misleading, exaggerated, inaccurate, or unsubstantiated claims regarding the Product, its origin, its features, or its performance. Avoid subjective superlatives such as "best quality", "unbeatable" unless objectively verifiable. 

4.6. NOT include any website URLs, external links (unless specifically permitted under a Gajab.com programme, for reasons including without limitation for manufacturer warranty registration, and clearly disclosed), QR codes, email addresses, phone numbers, physical addresses, social media information, or any other contact details or mechanisms intended to direct users off the Gajab.com Platform or facilitate off-platform transactions. 

4.7. NOT include any hidden text, JavaScript, Flash, iframes, plugins, or other active scripting or potentially harmful code. Only basic text formatting (like bolding, italics, bullet points, paragraphs, if supported by the platform) should be used. 

4.8. Content must strictly comply with the restrictions outlined in Rule 3(1)(b) of the IT Rules, 2021. Sellers must not list items or include content that is defamatory, obscene, pornographic, paedophilic, invasive of privacy, harmful to minors, infringing intellectual property rights, hateful, discriminatory, related to money laundering or gambling, threatening the unity, integrity, defence, security or sovereignty of India, or its relations with foreign States, public order, or insulting any nation, or is otherwise unlawful in any manner whatsoever.

4.9. NOT contain comparisons to other sellers or derogatory comments about other listings or users. 

4.10 For Listings in the food, cosmetic, or pharmaceutical categories, the Seller shall clearly display the 'Best Before' or 'Expiry Date' and the Batch Number as required under FSSAI and Legal Metrology regulations.

5. PRODUCT IMAGE REQUIREMENTS

Images uploaded for Your Listing must meet the following standards:

5.1. Accuracy and Relevance: Images must accurately and fairly represent the actual item being offered for sale and its current condition. They must be relevant to the product listed. 

5.2. Actual Item Photos: Images must be of the actual item You are selling. Use of manufacturer's stock photos is generally discouraged and may be prohibited for certain categories or conditions (especially Used, Refurbished, Open Box, For Parts). If permitted for new, standard items, it must be clearly indicated, and providing actual photos is still highly recommended. For non-new items, actual photos showing the specific item and its condition are mandatory. 

5.3. Quality: Images must be clear, well-lit, in focus, and of sufficient resolution, and the image must feature the product against a clean, plain white background to allow Buyers and the Platform to inspect the item visually. Avoid blurry, distorted, or low-quality images. 

5.4. Representation: Show the product from multiple relevant angles where appropriate. The main image should clearly depict the primary product being sold. 

5.5. Background: The main image should preferably feature the product against a clean, plain, neutral background. Avoid cluttered or distracting backgrounds. 

5.6. Prohibited Overlays/Content: Images must NOT include: (a) Added promotional text (such as "Sale", "Free Shipping", price information). (b) Borders around the image. (c) Seller logos, watermarks (unless very small, non-obtrusive, and consistently applied per Company branding guidelines, if allowed at all. (d) Website URLs, email addresses, phone numbers, QR codes, or any other contact information or external links. (e) Graphics, illustrations, or placeholder images instead of actual product photos (unless specifically representing something like a digital service clearly). (f) Nudity, offensive, illegal, discriminatory, violent, or otherwise inappropriate content. 

5.7. Authenticity: Images must not be digitally altered or manipulated in a way that misrepresents the product's true appearance, features, or condition. Minor retouching (like brightness/contrast adjustments) is acceptable if it doesn't mislead. 

5.8. Intellectual Property: You must own the copyright or have obtained all necessary licences and permissions for all images You upload. Images must not infringe any third party's intellectual property rights. Do not use images copied from other websites or sellers without authorisation. 

6. PRODUCT CONDITION

6.1. You must accurately select the correct condition category, if applicable, for Your item from the options provided by the Platform. 

6.2. For non-new items, You must use actual photos (as required by Clause 5.2) that clearly depict the item's current condition, including any specific imperfections mentioned in the description. 

6.3. Misrepresenting the condition of an item (such as listing a used item as new, failing to disclose significant defects) is a serious violation of this Policy and may lead to Buyer disputes, negative feedback, refunds, returns, and enforcement actions against Your Account as outlined in Section 9.

7. PRICING REQUIREMENTS

7.1. The price displayed in Your Listing ("Selling Price") must be the total price payable by the Buyer for the product itself, stated clearly in Indian Rupees (INR). 

7.2. The Selling Price must be inclusive of all applicable taxes, including Goods and Services Tax (GST), unless the Platform provides a specific mechanism to display and calculate taxes separately at checkout, and this is clearly indicated to the Buyer. You are responsible for correctly determining the applicable GST rate for Your products. 

7.3. All prices must be accurate and not misleading. 

7.4. For products covered by the Legal Metrology (Packaged Commodities) Rules, 2011, You must clearly display the Maximum Retail Price (MRP) in the manner specified by the Platform. The Selling Price listed must not exceed the declared MRP. You must not display inflated or fictitious MRPs to exaggerate discounts. 

7.5. You must not engage in practices designed to mislead buyers about the price or value, such as setting an artificially low item price compensated by disproportionately high shipping charges. Shipping charges, if listed separately, must reasonably reflect actual shipping and handling costs. 

7.6. You must not engage in any form of price manipulation, collusion with other Sellers, or practices that violate applicable competition laws regarding pricing.

 

8. DUPLICATE LISTINGS

8.1. Creating duplicate Listings for the exact same item offered under identical terms (such as same product, same condition, same price, same fulfilment options) is generally prohibited

8.2. The purpose of this rule is to ensure fair visibility in search results for all Sellers and to provide a clear and uncluttered shopping experience for Buyers. 

8.3. Listings identified by the Company as prohibited duplicates may be removed without notice. Repeated violation of this rule may lead to further enforcement actions against Your Account.

9. CONSEQUENCES OF VIOLATING THIS POLICY

9.1. Violation of any provision of this Product Listing Policy constitutes a breach of the Seller Agreement. The Seller acknowledges and agrees that they are solely responsible and liable for their Listings, the products offered, and any violation of this Policy, applicable laws (including but not limited to IT Act, Consumer Protection Act, Legal Metrology Act, FSSAI Act, Drugs & Cosmetics Act, BIS Act, IP laws), or third-party rights. Gajab.com's role is limited to providing the Platform as an intermediary

9.2. Any such violation may result, in the Company's sole discretion, in one or more of the following actions being taken against You or Your Listings: (a) Immediate removal, modification, deactivation, or suspension of the non-compliant Listing(s). (b) Liquidated Damages of up to ₹50,000 (Rupees fifty thousand) or statutory per violation from Seller payouts. (c) Issuing a formal warning regarding the violation. (d) Imposing limitations on Your listing privileges including without limitation number of active listings and category restrictions. (e) Imposing limitations on your listing privileges and reducing the visibility or search ranking of Your Listings. (f) Temporarily suspending Your Seller Account or selling privileges. (g) Permanently terminating Your Seller Account and access to the Platform (as per the Seller Agreement). (h) Withholding payouts associated with transactions involving policy violations. (i) Any other action deemed necessary or appropriate by the Company, as permitted under the Platform Agreements or applicable law. (j) Reporting potentially illegal listings or activities discovered to appropriate law enforcement or regulatory authorities including without limitation Police, Consumer Affairs, BIS, FSSAI, Legal Metrology)

9.3. The Company reserves the right to determine, in its discretion, whether a Listing violates this Policy.

9.4 As detailed in the Seller Agreement, the Seller agrees to indemnify, defend, and hold harmless Gajab.com (Aeliya Technologies Private Limited), its affiliates, directors, officers, employees, and agents from and against any and all claims, losses, damages, liabilities, penalties, costs, and expenses (including legal fees) arising out of or related to: (i) Seller's breach of this Policy or other Platform Agreements; (ii) Seller's violation of any applicable law or regulation; (iii) Seller's infringement of any third-party rights (including intellectual property); (iv) any claims related to the Seller's products (including product liability, safety, quality, or misrepresentation claims); or (v) any taxes payable by the Seller.

9.5 We reserve the right, either directly or through a third-party agency, to conduct 'Mystery Shopping' or 'Sample Audits' of any Listing. If the product received is found to be counterfeit or non-compliant with the Listing, We shall exercise the actions detailed in Section 9.2.

10. POLICY UPDATES

This Product Listing Policy may be updated or modified by the Company from time to time. Changes will be communicated and become effective 7 (seven) days from the date of such notice, except for changes required by Law. You are responsible for regularly reviewing this Policy to ensure Your ongoing compliance.
