Please read these Terms and Conditions carefully. By using the Platform now or in the future, You (the buyer or the seller or any other user who is a legal person and of a legal age who have agreed to register on the Platform) indicate explicit acceptance of these terms.
These Terms and Conditions are in the form of an electric record and have been meticulously drafted as per the IT Act 2000.
The Domain name _____, the mobile App and the website (Buyer as well as Seller portal) are all collectively called “the Platform” and is owned by _____ hereinafter referred to as We/Us/Our.
Your use of the Platform is subject to You complying with all the rules mentioned under this Terms and Conditions, and in return We grant you a personal and non-exclusive right to enter and use the Platform for all Legal purposes.
Additionally, You agree that even if you use a portion of the services rendered by the Platform, you will still be governed by these Terms, as well as Terms that will be updated from time to time.
In the event the Terms are translated in any other language, the meaning and essence of the Terms in English shall always precede over the interpretation of any other language.
The Platform is a platform that users utilise to independently meet and interact with one another for their transactions. We act merely as an intermediary to allow You to buy/sell and list Your products on Our Platform. You will be directed to third-party pages to make payments to list and buy products on the Platform, however, We shall in no way be liable or involved in anysuch transactions.
We provide a marketplace on our Platform for sellers to list, publish and advertise and the buyers to buy. We do not own or manage any Intellectual Rights of any of these products and hence are not responsible for any ads, information and claims. In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we provide a structured mechanism to address complaints related to IP infringement.
Complaints must be submitted in writing to the designated Grievance Officer via email or postal mail, containing: a) Complainant’s name, address, and contact details; b) Description of the allegedly infringed intellectual property (trademark, patent, copyright, or design); c) Details of the infringing content (URLs, screenshots, or seller details); d) Proof of ownership (registration certificates, legal documentation, etc.); e) A statement asserting a good-faith belief that the use is unauthorized; f) A declaration of the accuracy of the information and complainant’s authority to act; g) The complainant’s digital or physical signature.
Upon receiving a complete complaint, the Platform shall: a) Review the claim and remove or disable access to the allegedly infringing content if warranted; b) Notify the alleged infringer, allowing them to submit a counter-notice with supporting evidence; c) Restore content if a valid counter-notice is received unless legal action is initiated within 14 days.For further details, please refer to our IP Complaint Submission Form. False or misleading complaints may lead to legal consequences. The Platform reserves the right to take action against misuse, including account suspension or termination.

You hereby grant Us an irrevocable, non-cancellable, perpetual, worldwide, non-exclusive, royalty-free, sub-licensable, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content You provide to list items including your personal data in connection with the Platform.
You grant Us the right to make available your content to any Third Party for the purpose of carrying the transaction and selling the prodcut.
We have the right to terminate Your access to the Platform if You are determined to be a repeat infringer or found to be indulging in any act contrary to these Terms. A repeat infringer is a user who has been notified of infringing activity more than twice. Further, We reserve the right to decide whether any content is appropriate and complies with these Terms.
We do not make any representations or warranties regarding specifics (such as quality, value, and saleability, legal title, creditworthiness, identity, performance of the Product) of the products or services proposed to be sold, offered to be sold or purchased on the Platform. We do not implicitly or explicitly support or endorse the sale or purchase of any products and services on the Platform. We accept no liability for any errors or omissions of third parties in relation to the products and services.

Account Deactivation procedure:
A supplier’s account may be deactivated for violating intellectual property rights, selling counterfeit or prohibited items, incomplete or fraudulent KYC, cancellation/surrender of GST registration, breach of platform policies, or repeated customer complaints. Additional grounds include poor ratings, delayed or failed deliveries, excessive cancellations, and outstanding payments to Platform. Suppliers will be notified of violations and given an opportunity to respond; failure to comply may result in suspension or permanent deactivation. Appeals may be considered with valid proof, but the final decision rests with the Platform.
Do’s and Dont’s
The sale of the following items is strictly prohibited on our platform in compliance with Indian laws and regulatory requirements: alcoholic beverages, tobacco products, prescription medicines, drugs, vaccines, medical devices requiring regulatory approval, firearms, ammunition, explosives, knives, narcotics, psychotropic substances, counterfeit or pirated goods, human organs, endangered animal products, fake currency, cryptocurrencies, securities, lottery tickets, pornographic or obscene material, government-issued documents (including but not limited to passports, Aadhaar cards, and ration cards), articles promoting communal disharmony or hate speech, hazardous chemicals, explosives, poisons, pesticides, and any item requiring a special license from the state or central government, including but not limited to wildlife products, precious metals, drones, and broadcasting equipment. Sellers are solely responsible for ensuring compliance with all applicable laws, and any violation may result in account suspension, legal action, or other necessary enforcement measures at Platform’s sole discretion.

You shall indemnify and hold Us, Our affiliates, subsidiaries, group companies (as applicable) and its respective officers, directors, agents, and our employees harmless from any claim, demand, or actions including reasonable attorneys’ fees made by any third party or penalty imposed due to or arising out of Your breach of the Terms, privacy policy and other policies or Your violation of any law, rules, regulations or the rights (including infringement of intellectual property rights) of a third party.
You acknowledge that all content other than the content you provide to list, buy or sell the products, is owned by Us and hence is subject to Intellectual rights protection.
Seller warrants that goods sold hereunder meet their descriptions or specifications, subject to use, storage and application thereof in accordance with and based on Seller’s standard tolerances, instructions of use and recommendations.
Unless the Seller shall within 30 days after delivery of the Goods, receive from the Buyer written notice of any matter or thing by reason whereof it is alleged that Goods are not in accordance with the Contract, Goods delivered shall be deemed to have been supplied, delivered and accepted in all respects in full conformity with the Contract and the Buyer shall be entitled neither to reject the same nor to raise any claim for damages or for other remedy in respect of any alleged negligence and/or breach of warranty and/or any condition.
Without prior approval and written permission, you may not create frames around our Webpages that alter in any way the visual presentation or appearance of our Website.
Platform shall issue sales invoices on behalf of suppliers based on the details provided by them. Any discrepancies or errors in the invoice must be reported to Gajab within a reasonable time for necessary corrections. Failure to notify within such time shall be deemed acceptance of the invoice as issued.
The sole responsibility for compliance with all applicable tax obligations, including but not limited to Goods and Services Tax (GST), Income Tax (IT), and Tax Deducted at Source (TDS), rests with the supplier. Platform shall bear no liability for any non-compliance, misreporting, or default in tax payments by the supplier.
The supplier shall comply with all applicable laws, rules, and regulations governing their business operations, including but not limited to taxation, consumer protection, and commercial laws.Platform shall not be held liable for any act, omission, or negligence on the part of the supplier in relation to such compliance.
In the event of any excess payment received by the supplier from the Platform he supplier shall be liable to return the excess amount within three (3) days from the date of intimation by the Platform. Failure to repay within the stipulated time may result in appropriate recovery measures, including but not limited to adjustment against future payments or legal action.
Once an optional service has been bought by the user it will not be possible to have the amount refunded, even though the service has not been used.
The Consumer Protection (E-commerce) Rules, 2020, as amended from time to time including but not limited to ensuring that descriptions, images and other content pertaining goods or services on the platform is accurate and corresponds directly with the appearance, nature, quality, purpose and other general features of such goods or services.
The Terms shall be governed, interpreted, and construed in accordance with the laws of India. The place of jurisdiction shall exclusively be Mumbai.
